  某_blank class=infotextkey>单位_blank class=infotextkey>get=_blank class=infotextkey>决_blank class=infotextkey>定集资建_blank class=infotextkey>get=_blank class=infotextkey>房,_blank class=infotextkey>get=_blank class=infotextkey>规_blank class=infotextkey>定凡本_blank class=infotextkey>单位职工购_blank class=infotextkey>get=_blank class=infotextkey>买_blank class=infotextkey>get=_blank class=infotextkey>房屋_blank class=infotextkey>get=_blank class=infotextkey>可享受_blank class=infotextkey>get=_blank class=infotextkey>20%左右的优_blank class=infotextkey>get=_blank class=infotextkey>惠。某(化名)于是报名_blank class=infotextkey>get=_blank class=infotextkey>参加团购。_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>2009年_blank class=infotextkey>get=_blank class=infotextkey>2月,某与_blank class=infotextkey>get=_blank class=infotextkey>王某私_blank class=infotextkey>get=_blank class=infotextkey>下签订_blank class=infotextkey>get=_blank class=infotextkey>协议,约_blank class=infotextkey>定将_blank class=infotextkey>get=_blank class=infotextkey>购_blank class=infotextkey>get=_blank class=infotextkey>房_blank class=infotextkey>指标_blank class=infotextkey>get=_blank class=infotextkey>转让给_blank class=infotextkey>get=_blank class=infotextkey>王某。_blank class=infotextkey>get=_blank class=infotextkey>作为对价,_blank class=infotextkey>get=_blank class=infotextkey>王某支付了_blank class=infotextkey>3_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>万元的_blank class=infotextkey>get=_blank class=infotextkey>转让费。_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>2009年_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>10月,某欲毁约,希望归还_blank class=infotextkey>3_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>万元_blank class=infotextkey>get=_blank class=infotextkey>本_blank class=infotextkey>get=_blank class=infotextkey>金及利息的_blank class=infotextkey>get=_blank class=infotextkey>方式_blank class=infotextkey>收_blank class=infotextkey>get=_blank class=infotextkey>回_blank class=infotextkey>get=_blank class=infotextkey>购买。结果被_blank class=infotextkey>get=_blank class=infotextkey>王某_blank class=infotextkey>继续履行_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>合同或者_blank class=infotextkey>get=_blank class=infotextkey>赔偿_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>10_blank class=infotextkey>get=_blank class=infotextkey>万元_blank class=infotextkey>为由_blank class=infotextkey>get=_blank class=infotextkey>拒绝。_blank class=infotextkey>get=_blank class=infotextkey>双方因此而起_blank class=infotextkey>get=_blank class=infotextkey>纠纷。

  二、_blank class=infotextkey>get=_blank class=infotextkey>法律_blank class=infotextkey>get=_blank class=infotextkey>分析:

  对于本案,笔者拟提两点_blank class=infotextkey>get=_blank class=infotextkey>意见:

  1._blank class=infotextkey>get=_blank class=infotextkey>购_blank class=infotextkey>get=_blank class=infotextkey>房_blank class=infotextkey>指标_blank class=infotextkey>get=_blank class=infotextkey>转让_blank class=infotextkey>get=_blank class=infotextkey>协议应当_blank class=infotextkey>get=_blank class=infotextkey>有效。

  _blank class=infotextkey>get=_blank class=infotextkey>法律对民事_blank class=infotextkey>get=_blank class=infotextkey>行为采取_blank class=infotextkey>get=_blank class=infotextkey>一种宽容态度,即只要_blank class=infotextkey>不违背_blank class=infotextkey>get=_blank class=infotextkey>法律、行_blank class=infotextkey>政_blank class=infotextkey>get=_blank class=infotextkey>法规的强行性_blank class=infotextkey>get=_blank class=infotextkey>规_blank class=infotextkey>定,属于_blank class=infotextkey>get=_blank class=infotextkey>双方_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>真实_blank class=infotextkey>get=_blank class=infotextkey>意思_blank class=infotextkey>get=_blank class=infotextkey>表示,便可赋予其_blank class=infotextkey>合法性,而_blank class=infotextkey>不强求其符_blank class=infotextkey>合_blank class=infotextkey>法_blank class=infotextkey>定形式。就本案而言,_blank class=infotextkey>get=_blank class=infotextkey>购_blank class=infotextkey>get=_blank class=infotextkey>房_blank class=infotextkey>指标能否_blank class=infotextkey>get=_blank class=infotextkey>成为_blank class=infotextkey>get=_blank class=infotextkey>买卖的标的物,在_blank class=infotextkey>get=_blank class=infotextkey>理论_blank class=infotextkey>get=_blank class=infotextkey>上尚_blank class=infotextkey>get=_blank class=infotextkey>存在一_blank class=infotextkey>_blank class=infotextkey>定的_blank class=infotextkey>get=_blank class=infotextkey>争议。但_blank class=infotextkey>不管_blank class=infotextkey>get=_blank class=infotextkey>如何,在某、_blank class=infotextkey>get=_blank class=infotextkey>王某签订_blank class=infotextkey>get=_blank class=infotextkey>购_blank class=infotextkey>get=_blank class=infotextkey>房_blank class=infotextkey>get=_blank class=infotextkey>协议之_blank class=infotextkey>时,_blank class=infotextkey>get=_blank class=infotextkey>双方对_blank class=infotextkey>get=_blank class=infotextkey>购_blank class=infotextkey>get=_blank class=infotextkey>房_blank class=infotextkey>get=_blank class=infotextkey>事项均_blank class=infotextkey>get=_blank class=infotextkey>有_blank class=infotextkey>get=_blank class=infotextkey>相当程度的_blank class=infotextkey>get=_blank class=infotextkey>了解,_blank class=infotextkey>get=_blank class=infotextkey>对其_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>中的_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>风险、_blank class=infotextkey>get=_blank class=infotextkey>前景都了然于胸。虽然_blank class=infotextkey>他们缺乏_blank class=infotextkey>get=_blank class=infotextkey>法律_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>常识,但该_blank class=infotextkey>get=_blank class=infotextkey>协议的确是_blank class=infotextkey>get=_blank class=infotextkey>双方自愿签订,并_blank class=infotextkey>不_blank class=infotextkey>get=_blank class=infotextkey>存在任何威胁、引诱的成分,属于_blank class=infotextkey>get=_blank class=infotextkey>双方_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>真实_blank class=infotextkey>get=_blank class=infotextkey>意思_blank class=infotextkey>get=_blank class=infotextkey>表示。

class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank class=infotextkey>地产_blank class=infotextkey>get=_blank class=infotextkey>管理法》的禁止性_blank class=infotextkey>get=_blank class=infotextkey>规_blank class=infotextkey>定,根据《_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>合同法》_blank class=infotextkey>第5_blank class=infotextkey>get=_blank class=infotextkey>2条_blank class=infotextkey>第(五)项_blank class=infotextkey>get=_blank class=infotextkey>关于_blank class=infotextkey>get=_blank class=infotextkey>“违反_blank class=infotextkey>get=_blank class=infotextkey>法律和行_blank class=infotextkey>政_blank class=infotextkey>get=_blank class=infotextkey>法规无_blank class=infotextkey>get=_blank class=infotextkey>明确的字句条款对集资_blank class=infotextkey>get=_blank class=infotextkey>房_blank class=infotextkey>get=_blank class=infotextkey>转让_blank class=infotextkey>get=_blank class=infotextkey>有禁止_blank class=infotextkey>get=_blank class=infotextkey>规_blank class=infotextkey>定,但《_blank class=infotextkey>get=_blank class=infotextkey>城市_blank class=infotextkey>get=_blank class=infotextkey>_blank class=infotextkey>get=_blank
